These Terms of Service ("Terms") govern your access to and use of the SendWing platform ("Service"). By creating an account, you agree to be bound by these Terms.

1. Account Registration
To use SendWing, you must create an account with a valid email address. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Providing accurate and up-to-date account information
You must be at least 18 years old to create an account.
2. Acceptable Use
You agree to use SendWing only for lawful email marketing purposes. You must:
- Only email people who have opted in - All recipients must have given explicit consent
- Include an unsubscribe link - Every marketing email must contain a working unsubscribe mechanism
- Honor unsubscribe requests - Remove unsubscribed contacts within 24 hours
- Include your physical address - As required by CAN-SPAM and similar regulations
- Use accurate sender information - Your "From" name and email must be truthful
Prohibited: Sending spam, using purchased/scraped lists, phishing, malware distribution, promoting illegal services, impersonation, and circumventing rate limits. Violations result in immediate account termination.
3. Plans and Payment
- Free plans are available with limited features and quotas
- Paid plans are billed monthly or annually as specified at checkout
- Payments are processed securely via Stripe
- Plans auto-renew unless cancelled before the renewal date
- Prices may change with 30 days advance notice
- No refunds for partial billing periods, except where required by law
4. Your Content and Data
You retain full ownership of all content you upload, create, or send through SendWing. You grant us a limited license to process this content solely to provide the Service. You are responsible for ensuring you have the right to use and send all content.
5. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for damages resulting from service interruptions.
6. Third-Party SMTP
SendWing allows you to connect your own SMTP providers. We are not responsible for the availability, performance, deliverability, or charges of your SMTP provider. Your use of third-party services is governed by your agreement with those providers.
7. Limitation of Liability
To the maximum extent permitted by law, SendWing shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, you may export your data within 30 days. After 30 days, data is permanently deleted.
9. Changes
We may update these Terms from time to time. We will notify you of significant changes via email. Continued use after changes take effect constitutes acceptance.
